Terms of service

1. Acceptance of Terms
By using our enclosed vehicle transport services or accessing our website, you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.
2. Service Description
We operate as a transportation broker, arranging enclosed vehicle transport services nationwide within the United States. We connect customers with qualified, licensed, and insured carriers who provide the actual pickup, transport, and delivery of vehicles using enclosed trailers to protect vehicles from weather and road debris during transit.
3. Booking and Reservations
3.1 Quote Validity
All quotes are valid for 30 days from the date issued unless otherwise specified. Prices are subject to change based on fuel costs, route modifications, and other factors.
3.2 Booking Confirmation
A transport order is confirmed only upon:
- Receipt of signed transport agreement
- Payment of required deposit
- Vehicle inspection and documentation
3.3 Cancellation Policy
- Customer may cancel up to 24 hours before scheduled pickup with full refund of deposit
- Cancellations with less than 24 hours notice may result in cancellation fees
- We reserve the right to cancel service due to weather, mechanical issues, or other unforeseen circumstances
4. Payment Terms
4.1 Broker Fee and Carrier Payment
- A broker fee is required to secure our services and assign a carrier
- Payment to the carrier is arranged separately and subject to carrier’s terms
- Final payment is typically due to the carrier upon delivery via cash, certified check, or money order
- Payment methods accepted by carriers may vary
4.2 Broker Fees and Refunds
- Our broker fee is non-refundable once a carrier has been assigned
- Any deposit paid to the carrier is subject to the carrier’s individual terms and conditions
- We will provide carrier contact information and payment instructions
5. Vehicle Preparation and Inspection
5.1 Customer Responsibilities
Prior to pickup, Customer must:
- Ensure vehicle is in operable condition with no more than 1/4 tank of fuel
- Remove all personal items (we are not responsible for items left in vehicle)
- Provide all keys and necessary documentation
- Be present or designate an authorized representative for pickup and delivery
5.2 Vehicle Inspection
A detailed inspection will be conducted at pickup and delivery. Customer must sign the inspection report acknowledging the vehicle’s condition.
6. Liability and Insurance
6.1 Broker Role
As a transportation broker, we arrange transport services but do not physically transport vehicles. The assigned carrier is responsible for all aspects of vehicle handling, transport, and delivery.
6.2 Carrier Insurance and Liability
All assigned carriers are required to maintain:
- Valid DOT and MC numbers
- Comprehensive cargo insurance
- General liability insurance
- All required licenses and permits
The assigned carrier is solely responsible for any damage to or loss of your vehicle during transport.
6.3 Our Role and Limitations
As a broker, our role is limited to:
- Matching customers with qualified carriers
- Facilitating communication between parties
- Assisting with claim coordination
We are not liable for:
- Vehicle damage or loss during transport
- Carrier delays or service failures
- Acts or omissions of the assigned carrier
- Consequential or indirect damages of any kind
6.4 Claim Procedures
All damage claims must be:
- Reported to the assigned carrier within 24 hours of delivery
- Documented with photos and detailed descriptions
- Filed directly with the carrier’s insurance company
- We will assist in coordinating claims but are not responsible for claim outcomes
7. Delivery Terms
7.1 Delivery Windows
Delivery dates are estimates based on distance and current schedule. We will provide regular updates on transport progress.
7.2 Delivery Requirements
- Customer or authorized representative must be present for delivery
- Payment in full is required before vehicle release
- Customer must inspect vehicle and sign delivery receipt
7.3 Storage
If customer is unavailable for delivery, vehicle may be stored at our facility or authorized location at customer’s expense.
8. Prohibited Items and Vehicles
We do not transport:
- Vehicles with mechanical issues preventing safe loading/unloading
- Vehicles containing hazardous materials
- Stolen or salvage vehicles without proper documentation
- Vehicles with significant body damage affecting transport safety
9. Force Majeure
We are not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to: weather conditions, natural disasters, government regulations, labor disputes, or mechanical breakdowns.
10. Dispute Resolution
10.1 Governing Law
These Terms are governed by the laws of Georgia.
10.2 Arbitration
Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
11. Privacy Policy
We respect your privacy and handle personal information in accordance with applicable laws. Vehicle and customer information is kept confidential and used only for transport purposes.
12. Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on our website and take effect immediately upon posting.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
